Privacy Policy

This Policy governs information collected through our website only. For questions about protected health information collected during care, please refer to our Notice of Privacy Practices or contact our office directly.

1. Introduction

This Privacy Policy (the "Policy") describes how Zarlasht Fakiri, P.C., a California professional medical corporation doing business as L.I.V.E. Wellness Medspa ("we," "us," or "our"), collects, uses, discloses, and protects information about visitors to and users of our website located at https://www.livewellnessmedspa.com and any related online services that link to this Policy (collectively, the "Site").

This Policy applies only to information collected through the Site and through online or electronic communications with us. It does not apply to protected health information ("PHI") that we collect, use, or disclose in the course of providing medical, aesthetic, or wellness services to our clients. The privacy of PHI is governed by our separate Notice of Privacy Practices, which is provided to clients in accordance with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), the California Confidentiality of Medical Information Act ("CMIA"), and other applicable laws. A copy of our Notice of Privacy Practices is available upon request at our office.

By accessing or using the Site, you agree to the collection, use, and disclosure of information as described in this Policy. If you do not agree with this Policy, please do not use the Site.

2. Information We Collect

2.1 Information You Provide to Us

We collect information that you voluntarily provide when you interact with the Site, including when you:

Complete a contact form, consultation request, appointment inquiry, or newsletter signup;
Communicate with us by email, telephone, SMS, or chat initiated through the Site;
Request information about our services, special offers, or events;
Submit testimonials, reviews, or other content; or
Interact with embedded third-party booking, payment, or scheduling tools accessed through the Site.

The information you provide may include your name, email address, telephone number, mailing address, date of birth, areas of aesthetic or wellness concern, photographs you choose to submit, payment information, and any other information you elect to share.

Please do not submit detailed health, diagnostic, or treatment information through the Site. The Site is not a secure channel for the transmission of PHI. If you need to communicate clinical information, please contact our office at (916) 964-2003 or through the client portal we make available to active clients.

2.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information about your device and your interaction with the Site, including:

Device and connection data, such as IP address, browser type and version, operating system, device identifiers, and language settings;
Usage data, such as the pages you view, the links you click, referring and exit pages, dates and times of visits, and time spent on pages;
Approximate geographic location derived from your IP address; and
Information collected through cookies, pixels, tags, web beacons, and similar tracking technologies (collectively, "cookies").

2.3 Information from Third Parties

We may receive information about you from third-party sources, such as analytics providers, advertising networks, social media platforms (for example, when you engage with our pages on Facebook or Instagram), online review platforms, and the third-party booking and scheduling tools we use (for example, MyAestheticsPro). The information we receive depends on your settings and the privacy practices of those third parties.

3. Cookies and Similar Technologies

We use cookies and similar technologies to operate, secure, and improve the Site, to remember your preferences, to analyze traffic, and to deliver relevant marketing. The categories we use include:

Strictly necessary cookies, which are required for the Site to function (for example, security and load balancing);
Performance and analytics cookies, such as Google Analytics and Google Tag Manager, which help us understand how visitors use the Site;
Functional cookies, which remember your preferences and choices; and
Advertising and social media cookies, which may be set by third parties to measure the effectiveness of campaigns and to deliver ads on other sites you visit.

Most web browsers allow you to control cookies through their settings. You can usually delete or block cookies, but doing so may affect the functionality of the Site. We do not currently respond to browser "Do Not Track" signals because no uniform standard has been adopted. We honor the Global Privacy Control ("GPC") signal as a valid opt-out of the "sale" or "sharing" of personal information for residents of California and other jurisdictions where required by law.

4. How We Use Information

We use the information we collect for the following purposes:

To respond to your inquiries, schedule consultations, and provide the information or services you request;
To operate, maintain, secure, and improve the Site and our services;
To send you administrative messages, appointment reminders, and service-related communications;
To send you marketing communications, special offers, and event invitations, where permitted by law and subject to your right to opt out;
To analyze usage trends, measure the effectiveness of our content and advertising, and develop new features;
To prevent, detect, and investigate fraud, abuse, or unauthorized access, and to enforce our Terms of Use and other policies;

5. How We Disclose Information

We do not sell personal information collected through the Site for monetary consideration. We may disclose information as follows:

To service providers that perform functions on our behalf, such as website hosting, email delivery, analytics, booking and scheduling, payment processing, customer support, and marketing, in each case subject to confidentiality and use restrictions;
To advertising and social media partners that help us measure and deliver marketing; certain of these disclosures may be considered "sharing" for cross-context behavioral advertising under California law (see Section 8 below);
To professional advisors, including attorneys, accountants, auditors, and insurers;
In connection with a corporate transaction such as a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy, in which case information may be transferred to the successor or acquirer;
When we believe in good faith that disclosure is necessary to comply with law, respond to legal process, protect the rights, property, or safety of our clients, employees, or others, or investigate or respond to suspected wrongdoing; and
With your consent or at your direction.

6. Third-Party Tools, Links, and Platforms

The Site may contain links to third-party websites, platforms, and tools, including our online booking platform (MyAestheticsPro), our profiles on Facebook and Instagram, Google Maps, and other resources. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before providing any information.

7. Email, SMS, and Marketing Choices

You may opt out of marketing emails at any time by using the "unsubscribe" link in any marketing email or by contacting us using the information in Section 12. If you receive text messages from us, you may opt out by replying STOP. We may still send you transactional messages, such as appointment confirmations or service notices, even after you opt out of marketing.

8. California Privacy Rights

This section provides additional information for residents of California under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA").

8.1 Categories of Personal Information

In the preceding twelve (12) months, we may have collected the following categories of personal information from Site visitors:

Identifiers (such as name, email address, telephone number, mailing address, and IP address);
Customer records information (such as contact details and information you submit through forms);
Commercial information (such as inquiries about our services and any transactions facilitated through the Site);
Internet or other electronic network activity (such as browsing history on our Site, usage data, and interactions with our communications);
Geolocation data (approximate location derived from IP address);
Inferences drawn from the above categories to create a profile reflecting preferences and characteristics; and
Sensitive personal information, only to the extent you choose to provide it (for example, health-related information you submit through a contact form). We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA without additional notice.

We collect personal information from the sources described in Section 2 and use and disclose it for the purposes described in Sections 4 and 5.

8.2 "Sale" and "Sharing"

We do not sell personal information for monetary consideration. However, the use of certain advertising and analytics cookies may be considered a "sale" or "sharing" of personal information under the CCPA. We do not knowingly sell or share the personal information of consumers under sixteen (16) years of age. You can opt out of the sale or sharing of your personal information by enabling the Global Privacy Control in your browser, by using the cookie preferences tool on the Site (if available), or by contacting us as described in Section 12.

8.3 Your California Rights

Subject to certain exceptions, California residents have the right to:

Know the categories and specific pieces of personal information we have collected about them, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it;
Request deletion of personal information we have collected from them;
Request correction of inaccurate personal information;
Opt out of the sale or sharing of personal information;
Limit the use and disclosure of sensitive personal information to certain permitted purposes;
Receive a copy of personal information in a portable format; and
Not be subjected to retaliation for exercising any of these rights.

To exercise your rights, please contact us using the information in Section 12. We will verify your request by asking you to provide information that matches information we maintain about you. You may designate an authorized agent to act on your behalf; we will require written authorization and verification of the agent's authority.

This Policy does not apply to information that is regulated as protected health information under HIPAA or as medical information under the CMIA, which is excluded from the CCPA. Requests concerning that information should be directed to the privacy contact identified in our Notice of Privacy Practices.

9. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect through the Site. No method of transmission over the internet and no method of electronic storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for the security of your devices.

10. Data Retention

We retain personal information collected through the Site for as long as necessary to fulfill the purposes for which it was collected, including to provide the services you request, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we will dispose of it in a secure manner.

11. Children's Privacy

The Site is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen (13). If we learn that we have collected personal information from a child under thirteen (13), we will take steps to delete it. If you believe a child has provided us with personal information, please contact us using the information below.

13. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will revise the "Last Updated" date at the top of this Policy and, where required by law, provide additional notice. Your continued use of the Site after the effective date of any updated Policy constitutes your acceptance of the changes.

14. Additional Disclosures

14.1 International Visitors

The Site is operated from the United States and is intended for users located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your jurisdiction.

14.2 California "Shine the Light"

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for those third parties' direct marketing purposes. We do not share personal information collected through the Site with third parties for their own direct marketing purposes.
