These Terms of Use (the "Terms") constitute a legally binding agreement between you and Zarlasht Fakiri, P.C., a California professional medical corporation doing business as L.I.V.E. Wellness Medspa ("we," "us," or "our"), governing your access to and use of our website located at https://www.livewellnessmedspa.com and any related online services, content, and features that link to these Terms (collectively, the "Site").

By accessing or using the Site, you represent that you are at least eighteen (18) years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, please do not access or use the Site.

A provider-client relationship is established only when you have been accepted as a client by our practice and have completed the required intake process.

The L.I.V.E. Wellness Medspa name, logo, and all related marks, product names, and slogans are trademarks or service marks of Zarlasht Fakiri, P.C. You may not use any of our marks without our prior written permission.

Third-party trademarks, service marks, and trade names that appear on the Site are the property of their respective owners. References to third-party products, services, or organizations do not constitute or imply endorsement.

You may print or download a single copy of individual pages from the Site for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices. Any other use requires our prior written consent.

5. Before-and-After Images and Testimonials

Before-and-after photographs and client testimonials displayed on the Site are provided for illustrative purposes only. Individual results vary and are not guaranteed. The images and statements reflect the experiences of specific individuals and may not be representative of the results that other clients will achieve.

Some before-and-after images on the Site are courtesy of third-party physicians and are used with permission. Those images are credited to their respective sources and remain the intellectual property of those sources.

Testimonials are the opinions of individual clients and do not constitute medical claims or endorsements of any particular outcome.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages, so some of the above limitations may not apply to you.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Placer County, California. You consent to the personal jurisdiction of those courts and waive any objection to venue.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.
